O'boro responds to counterclaim filed by Gabe's Tower owners | News
OWENSBORO, KY (WFIE)-
The city denies the allegations made in the counterclaim.
The owners say in their counterclaim that the city has negatively affected the value of the Gabe's Tower property and interfered with the owners trying to find a buyer for the property.
The city says the owners owe the city around $18,000 for a lein placed on the property and for fines. They are filling a motion for summary judgement in the next 30 days.
"We are hoping the judge will grant that motion for summary judgement and will refer it to the master commissioner for sale so we can collect the amount the judgement leans, fines, costs that we have involved in the property," said Stephen D. Lynn, the Assistant City Attorney of Owensboro.
A Daviess County judge will set a court date and look at the case after the city files a summary judgement motion.
